Appeal against judgment granting divorce by mutual consent.

You have received the judgment from the Family Court in which the divorce was pronounced by mutual consent between you and your spouse, but you have meanwhile decided not to divorce and to give your marriage another chance? 

You must then lodge an appeal against this divorce judgment as soon as possible. After all, you can only appeal within one month from the date of the judgment, and not the date of the letter informing you of the judgment.

We offer this service for a fixed price of EUR 1000.00 VAT 21 % included. You can opt to pay this amount in one go via the payment module or to pay an advance of EUR 500.00.

Please note, if the procedure consists of more than two sessions, an additional lump sum of EUR 400.00 (including VAT) will be charged for each additional session.

What is not included in our price?

Our price does not include:

The process costs:

  • court order in first instance (EUR 165.00), which the family court has already imposed on both spouses;
  • right of appeal in appeal (EUR 400.00). Afterwards to be paid to the Belgian State. The Court of Appeal will charge this right of roll when the decision is rendered;

Costs to third parties:

  • any costs of administrative certificates (proof of family composition), a few euros. We shoot this one.

So make sure to check that the following conditions are met:

  • There is a judgment of the Family Court in which the divorce by mutual consent (EOT) was pronounced. A divorce judgment in which the divorce was pronounced on the basis of irreparable disruption (EOO) is not eligible for this service!
  • The expiry period of 1 month from the date of the divorce decree has not yet expired.
  • You have been reconciled as spouses, which means that you are living together again, or have the intention of living together again soon.
