Position of Flemish “rent” powers vs. federal competence – which competences with which government
Discussion of the main changes in the Flemish housing rental decree:
- The scope of application: main residence and student housing. Although the Flemish government is competent for all specific rules regarding the rental of residential property (including holiday homes, second homes, etc.), the new decree is initially limited to the main residences and student rooms.
- What information is the landlord allowed to request? What can and what can't?
- Extension of the cancellation options: relaxation of the cancellation notice for renovation. Introduction of termination options for short-term contracts.
- Protection of the tenant. Compulsory fire insurance for the tenant.
- Rent deposit increased. In exchange for the increase, an anonymous, interest-free 'government' rental guarantee loan will be created to lower the barrier to the private rental market for the very weakest.
- Arrangement in case of death of the tenant. Termination of the lease becomes easier when the heirs have rejected the estate or have remained unknown.
- Co-rent arrangement. Both the institutionalized partner relationships (married and legal cohabitants) and the actual partners and "cohabitants" are discussed.
- Explanation of the rules regarding the rental of student rooms.
